Welcome to 360HRIS. These Terms of Service (“Terms”) govern your access to and use of our Human Resources Software-as-a-Service platform, applications, and related services (collectively, the “Service”).

By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of the Service

You may access and use the Service solely for your organization’s internal HR operations, in compliance with all applicable laws and these Terms. You are responsible for all activity that occurs under your account.

You agree not to:

  • Use the Service for any unlawful or unauthorized purpose
  • Attempt to reverse engineer or gain unauthorized access to any part of the Service
  • Upload or transmit any viruses or malicious code

2. Account Registration

To use our Service, your organization must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Subscription and Payment

Access to the Service requires a valid subscription, as outlined in your selected pricing plan. By subscribing, you agree to pay all fees and charges associated with your plan in accordance with the billing terms presented at the time of subscription.

Billing Cycle:

Subscriptions are billed in advance on a monthly or annual basis, depending on your selection during registration.

Changes or Cancellations:

You may upgrade, downgrade, or cancel your subscription at any time. However, we require a minimum of 90 days’ written notice to cancel or significantly downgrade your subscription to allow for appropriate processing and transition. Cancellations will take effect at the end of the current billing period following the notice period.

Refunds:

Except as required by law or explicitly stated in your service agreement, all fees are non-refundable.

Suspension for Non-Payment:

We reserve the right to suspend or terminate your access to the Service if timely payment is not received. Reactivation may be subject to additional fees.

4. Data Privacy and Security

We are committed to protecting your data. Please review our Data Privacy and Security Policy for details on how we collect, use, and protect your information in accordance with PIPEDA and other applicable regulations.

5. Intellectual Property

All content, features, and functionality of the Service (including software, UI, and trademarks) are the exclusive property of 360HRIS. Users are granted a limited, non-transferable license to use the Service.

6. Customer Data

You retain ownership of any data you upload to the platform. We act as a data processor, handling your data according to your instructions and applicable data protection laws.

You are responsible for ensuring the legality, reliability, and accuracy of any data you provide.

7. Termination

You may cancel your subscription at any time. We reserve the right to suspend or terminate your access to the Service for violation of these Terms or for legal compliance reasons.

Upon termination, your data will be handled in accordance with our data retention and deletion policy.

8. Limitation of Liability

To the maximum extent permitted by law, 360HRIS shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
